成都市行政效能监察办法
第一条 (目的依据)
为加强行政效能监察,推进依法行政,改善行政管理,提升行政效能,改进机关作风,优化发展环境,促进规范化服务型政府(机关)建设,根据《中华人民共和国行政监察法》、《中华人民共和国公务员法》等法律、法规和规章,结合成都市实际,制定本办法。
第二条 (适用范围)
本办法适用于本市各级行政机关及其公务员。行政机关任命的其他人员和经批准参照《中华人民共和国公务员法》管理的事业单位及其工作人员,参照本办法执行。
第三条 (术语含义)
本办法所称行政效能监察,是指监察机关依据有关法律、法规和规章,对行政机关及其公务员履行职责行为的效率与质量情况所实施的检查、调查、纠正、问责等活动。
第四条 (遵循原则)
行政效能监察工作应当坚持行政效能监察与行政效能建设相结合、预防与治理相结合、教育与惩处相结合的原则。
第五条 (监察职责)
监察机关开展行政效能监察,依法履行下列职责:
(一)组织协调和指导本行政区域内行政效能监察工作;
(二)监督检查、考核评价机关行政效能和软环境建设情况;
(三)受理涉及行政效能和软环境问题的投诉举报;
(四)检查、调查行政机关及其公务员在行政活动中影响行政效能的行为和问题;
(五)根据检查、调查或评议考核结果等,对行政机关及其公务员实施行政问责或提出处理意见、建议;
(六)法律、法规和规章规定的其他职责。
第六条 (监察重点)
监察机关开展行政效能监察时,重点检查、调查下列影响行政效能的行为和事项:
(一)不按规定贯彻落实或违背上级政策、决定的;
(二)不依法正确履行职责,对管理事项不按规定制定执行措施、做出行政决定的;
(三)不按规定实行政务公开,损害行政相对人知情权的;
(四)不落实首问负责制度,增加行政相对人办事成本或难度的;
(五)不落实限时办结制度,推诿拖延的;
(六)不落实工作制度,对职责范围内的事项不按时限和质量要求完成的;
(七)应当纳入政务服务中心办理的事项而未纳入的;
(八)行政许可和非行政许可审批事项等不按规定纳入电子监察系统的;
(九)涉及多个部门的工作,牵头部门不履行牵头职责,或配合部门不配合牵头部门工作,造成工作延误的;
(十)不文明执行公务,造成不良影响和后果的;
(十一)其他违反行政管理规定,损害行政效能的事项。
第七条 (工作方式)
行政效能监察以日常监察和专项监察相结合的方式进行。日常监察包括受理投诉和检查、调查、暗访、评估,以及运用电子监察系统实时监控等方式。
监察机关可以组织有关行政机关工作人员,或邀请人大代表、政协委员、特邀监察员以及民主党派、社团组织、市民代表等有关人士参加行政效能监察。
第八条 (行政效能投诉)
监察机关应当建立健全行政效能投诉制度,向社会公布受理投诉、举报的方式、方法。
第九条 (行政效能评估)
监察机关应当建立行政效能考核评估制度,与社会评价和软环境测评一并进行,促进行政机关不断提高行政效能。
第十条 (专项监察立项)
监察机关主要根据下列情况确定行政效能专项监察事项:
(一)本级人民政府和上级监察机关的部署和要求;
(二)本级人民政府的中心工作和重点工作;
(三)本级人民政府重大投资项目专项财政性资金的使用情况;
(四)人民群众反映强烈的损害行政效能的问题。
第十一条 (专项监察批准和备案)
行政效能专项监察事项的立项由监察机关负责人批准。重要专项监察事项的立项,还应当报本级人民政府备案。
第十二条 (专项监察实施)
实施行政效能专项监察应当制定方案,并经监察机关负责人批准后实施。
第十三条 (专项监察通知)
实施行政效能专项监察,应当向被监察的单位发出行政效能专项监察通知书。通知书应当载明主要内容、时间安排和具体要求。通知书由监察机关负责人签发。对涉及范围较广的行政效能专项监察事项,监察机关可以视情况将专项监察方案一并通知被监察的单位。
第十四条 (专项监察报告)
实施行政效能专项监察,应当全面客观地了解情况,收集证据,查清问题及原因,听取被监察的单位和人员的陈述和申辩,实事求是地提交监察报告,并提出处理意见。
监察报告应当包括下列内容:检查或调查的基本情况,存在的问题及产生原因,被监察的单位和人员的主要责任,处理依据、意见,以及加强管理、完善制度、改进工作的建议。
第十五条 (效能监察结果处理)
监察机关根据效能监察结果,开展行政问责,作出监察建议、监察决定等处理。作出重要监察建议或重要监察决定,应当报经本级人民政府同意。
第十六条 (行政问责方式)
依据《四川省行政机关工作人员行政过错责任追究试行办法》、《四川省行政机关责任追究制度》、《四川省行政效能告诫办法(试行)》等规定,由监察机关或任免机关采取以下方式实施行政问责:
(一)行政效能告诫或诫勉谈话;
(二)责令作出书面检查或公开道歉;
(三)通报批评;
(四)取消年度评优评先资格;
(五)调离工作岗位;
(六)停职检查;
(七)免职、降职或责令辞职。
问责方式可以单独使用或合并使用。监察机关实施问责提出监察建议涉及组织处理的,按照有关规定执行。
法律、法规和规章对行政问责另有规定的,从其规定。
第十七条 (从重或加重处理情形)
有下列情形的,应当从重或加重处理:
(一)受到行政问责后一年内,又因行政效能问题应当受到责任追究的;
(二)干扰、阻碍调查处理的;
(三)对投诉举报人打击、报复的。
第十八条 (从轻或减轻处理情形)
主动发现错误并采取补救措施的,可以从轻、减轻或免予行政问责。
第十九条 (行政问责救济)
被问责人员对行政问责不服的,可按照有关规定申请复审、复核和申诉。
第二十条 (行政问责结果运用)
监察机关或任免机关应当将行政问责结果抄送同级公务员主管机关,任免机关作出的行政问责结果还应当抄送同级监察机关,作为公务员考核任用的重要依据。
第二十一条 (解释机关)
本办法具体应用中的问题由成都市监察局负责解释。
第二十二条 (施行日期)
本办法自2009年9月1日起施行。2004年4月2日成都市人民政府发布的《成都市国家公务员行政效能投诉和告诫暂行办法》同时废止。

一九五九年国务院发布《关于统一计量制度的命令》,确定米制为我国的基本计量制度以来,全国推广米制、改革市制、限制英制和废除旧杂制的工作,取得了显著成绩。为贯彻对外实行开放政策,对内搞活经济的方针,适应我国国民经济、文化教育事业的发展,以及推进科学技术进
步和扩大国际经济、文化交流的需要,国务院决定在采用先进的国际单位制的基础上,进一步统一我国的计量单位。经一九八四年一月二十日国务院第二十一次常务会议讨论,通过了国家计量局《关于在我国统一实行法定计量单位的请示报告》、《全面推行我国法定计量单位的意见》和《
中华人民共和国法定计量单位》。现发布命令如下:
一、我国的计量单位一律采用《中华人民共和国法定计量单位》(附后)。
二、我国目前在人民生活中采用的市制计量单位,可以延续使用到一九九0年,一九九0年底以前要完成向国家法定计量单位的过渡。农田土地面积计量单位的改革,要在调查研究的基础上制订改革方案,另行公布。
三、计量单位的改革是一项涉及到各行各业和广大人民群众的事,各地区、各部门务必充分重视,制定积极稳妥的实施计划,保证顺利完成。
四、本命令责成国家计量局负责贯彻执行。
本命令自发布之日起生效。过去颁布的有关规定,与本命令有抵触的,以本命令为准。
中华人民共和国法定计量单位
我国的法定计量单位(以下简称法定单位)包括:
(1)国际单位制的基本单位(见表1);
(2)国际单位制的辅助单位(见表2);
(3)国际单位制中具有专门名称的导出单位(见表3);
(4)国家选定的非国际单位制单位(见表4);
(5)由以上单位构成的组合形式的单位;
(6)由词头和以上单位所构成的十进倍数和分数单位(词头见表5)。
法定单位的定义、使用方法等,由国家计量局另行规定。

DECREE OF THE STATE COUNCIL CONCERNING THE USE OF UNIFORM LEGAL
MEASURES IN THE COUNTRY
(Issued on February 27, 1984)
Since the State Council issued the Decree Concerning the Unification of
the System of Measurement in 1959, which stipulates that the metric system
is the basic system of measurement in the country, remarkable achievements
have been made in promoting the metric system, reforming the Chinese
market system, restricting the British system and abolishing the old and
mixed systems in China. In order to implement the policy of opening up to
the outside world and invigorating the economy at home, meet the needs of
developing the national economy and cultural and educational undertakings,
promote the advancement of science and technology and broaden
international economic and cultural exchanges, the State Council has
decided to further unify the measures of the country on the basis of
adopting the advanced international system of measurement. The 21st
Executive Meeting of the State Council held on January 20, 1984 discussed
and approved the following documents submitted by the State Measurement
Bureau: the Report Concerning the Use of Uniform Legal Measures in the
Country, the Suggestion Concerning the full Application of the Country's
Legal Measures, and the Legal Measures of the People's Republic of China.
The Decree is hereby issued:
I. The Legal Measures of the People's Republic of China (see the Appendix)
shall be adopted in any measurement in our country.
II. The Chinese market system of measures currently in use in daily
commercial activities may remain applicable till the end of 1990, before
which the transition to the national legal measures must be completed. As
for the reform of farmland measures, a reform plan shall be drawn up and
promulgated separately on the basis of investigation and study.
III. The reform of measures is a matter which concerns all walks of life
and broad masses of people. Leading cadres in the various localities and
departments must pay adequate attention to it and formulate vigorous and
reliable plans of implementation so as to ensure its successful
completion.
IV. The State Measurement Bureau shall be vested by this Decree with the
responsibility of the implementation thereof.
This Decree shall go into effect from the date of issuance. If any
previous provisions come into conflict with this Decree, this Decree shall
prevail.
THE LEGAL MEASURES OF THE PEOPLE'S REPUBLIC OF CHINA
The legal measures of the country (hereinafter referred to as the legal
measures) include:
(1) basic units of the international system of measurement (see Table 1);
(2) auxiliary units to the international system of measurement (see Table
2);
(3) units derived from the ones with special names in the international
system of measurement (see Table 3);
(4) units of non-international system of measurement chosen by the State
(see Table 4);
(5) units formed by combining the above units;
(6) units formed by the symbols (see Table 5) and the above units
multiplied or divided by 10.
The definitions, uses, etc. of the legal measures shall be stipulated
separately by the State Measurement Bureau.
